Commercial settlements often have a few more moving parts than residential transactions, such as leases, GST requirements, and additional property searches.

Title transfers (non-sale)
When property changes hands without a purchase. This covers things like gifting a property to a family member, or transferring equity from one owner to another.
Family transfers
Transfers between spouses, partners, or relatives. WA law treats these as related-party transactions, so specific requirements apply. We handle them regularly and we'll explain exactly what's needed.
Separation and divorce transfers
When property is transferred as part of a relationship breakdown. We handle these with care and discretion, working in line with any court orders or legal agreements already in place.
Family Court order transfers
When a property transfer is required by a Family Court order following separation proceedings. We make sure the transfer is completed exactly as the order sets out.
Adding or removing a person from title
When ownership of a property needs to change to reflect new circumstances. That might mean adding a partner to the title, or removing someone who no longer has an interest.
Transfers to trusts or companies
When a property is moved into a different legal structure, such as a family trust or a company. Related-party rules apply here too, and we'll advise on what's required.
Deceased estate transfers
When a property needs to be transferred after the death of an owner. This is often a difficult time for a family, so we handle it with care and guide the executor or beneficiary through each step.
Transmission applications
The formal legal process of transferring a deceased person's interest in a property to the surviving owner or the estate. We prepare and lodge the application on your behalf.
Survivorship applications
When one joint tenant passes away, the property passes to the surviving owner. We handle the application to Landgate so the title correctly reflects the change.
Change of name on title
After a name change through marriage, divorce, or any other legal reason, your title can be updated to match. It's a straightforward process and we'll handle it efficiently for you.
Private sales (no agent)
When a property is sold directly between buyer and seller without a real estate agent. We can prepare the Contract of Sale and manage the full settlement, which we strongly recommend in a private sale.
Land subdivision title applications
When land is subdivided into separate lots, each new lot needs its own title. We manage the application process with Landgate so your new titles are issued correctly and on time

They're essentially the same. "Settlement agent" is the licensed title under the Settlement Agents Act, while "conveyancer" is the term used more widely across Australia.
For most residential and commercial settlements in WA, no. A licensed settlement agent has everything required to manage your transaction from contract to completion. If something in your situation calls for legal advice beyond that, we'll tell you early.
You may be wondering why we need to ask for additional identification and information. These checks are not unique to MGM Settlements and are not a reflection on you personally. They are part of new legal obligations applying across the property and settlement industry.
From 1 July 2026, settlement agents will have additional obligations under Australia's Anti Money Laundering and Counter-Terrorism Financing (AML/CTF) laws. This means we may need to collect and verify certain information before we can progress parts of your property transaction.
These requirements are designed to help protect you and the wider property system from fraud, money laundering and other financial crime. We appreciate that providing additional information can feel like an extra step, but our team will guide you through the process and let you know exactly what is required.
